Terms of Use
These terms govern your use of Annecy74.com (the "Site"). Please read them before using the Site. By accessing, browsing or sending an enquiry through the Site you accept these terms in full. If you do not accept them, please do not use the Site.
Who we are
The Site is published and operated by the owners of the Annecy74 penthouse together with their appointed managers, agents and affiliates (together, "Annecy74.com", "we", "us" or "our"). References in these terms to us include our owners, officers, employees, managers, agents, affiliates, partners, contractors and successors in title.
The property to which the Site relates is a private residence in Annecy, Haute-Savoie, France. The Site is an information and enquiry service relating to that property. It is not a travel agency, a tour operator, a booking platform or an estate agency.
What the Site is, and is not
The Site describes a private residence, its setting and the services that may be arranged around a stay. Everything on the Site is provided for general information only.
Nothing on the Site is an offer capable of acceptance, an invitation to treat giving rise to binding obligations, a guarantee of availability, a quotation, a valuation, or advice of any kind — legal, tax, financial, insurance, travel, medical or otherwise. No contract for a stay or for any service comes into existence by your use of the Site or by your sending us an enquiry through it.
Descriptions and images
We take care to describe the property accurately, and the photographs are of the property itself. Even so, photographs, plans, dimensions, distances, journey times, capacities and descriptions are indicative only. Colours and proportions vary between screens. Furnishings, equipment, appliances, décor and finishes may be changed, substituted or removed at any time without notice. Views, outlooks and surroundings may change, including as a result of works, planting, weather, seasons or the acts of third parties.
Distances and travel times are approximations for orientation only and depend on traffic, weather, season, transport schedules and your own pace. Nearby attractions, beaches, restaurants, markets, lifts, pistes, transport and events are operated by third parties. Their existence, opening, condition, pricing and continued operation are outside our control and are not warranted by us.
Bookings and the rental contract
The Site does not take bookings and does not take payment. Bookings are made through the booking channels identified on the Site, each of which is operated by an independent third party under its own terms.
Any stay is governed by the rental contract, house rules, cancellation policy and payment terms presented to you by the relevant booking channel and, where applicable, by the property manager, at the time of booking. Those documents, and not the Site, set out your rights and obligations in relation to a stay. Where anything on the Site conflicts with the rental contract you have entered into, the rental contract prevails.
Rates and availability
Rates, minimum stays, deposits, taxes, tourist taxes, cleaning and service charges, occupancy limits, check-in and check-out times and availability are indicative, may change without notice, and are confirmed only at the point of booking through the relevant channel. Any rate shown on the Site is subject to availability and to confirmation.
Occupancy and house rules
The property is a private residence. Maximum occupancy is strictly limited and is stated at the time of booking. Parties, events, commercial photography, filming and gatherings beyond the booked party are not permitted. Smoking is not permitted indoors. Pets are not accepted. Sub-letting and assignment of a booking are not permitted. Breach of the house rules may result in immediate termination of a stay without refund, in addition to any other remedy.
Concierge and third-party services
The Site lists services that may be arranged around a stay — among them transport, catering, chefs, wellbeing treatments, boat hire, flights, guided activities and deliveries. Please read this section carefully, because it limits what we are responsible for.
We are an introducer, not the provider
Every one of those services is supplied by an independent third-party operator, not by us. We act only as an introducer and, at most, as an agent for the purpose of passing on a request. We are not the supplier of any service listed, we do not perform any of them, and we do not employ, control, supervise or direct the people who do.
Any service you take is a contract between you and the operator concerned, on that operator's own terms, and is subject to that operator's own insurance, licensing, qualifications, cancellation policy and liability. We are not a party to that contract.
Prices, availability and suitability
Prices shown for services are the operators' own, are indicative, are quoted for guidance in euro, and may change at any time — including seasonally, by group size, by duration and by the operator's own decision. Prices may exclude transport, equipment, insurance, taxes, gratuities and extras. A price on the Site is not a quotation and does not bind us or the operator. Availability is never guaranteed and many services require booking well in advance.
Certain activities carry inherent risk — including but not limited to flying, paragliding, helicopter and aircraft flights, boating, waterskiing, wakeboarding, wake surfing, swimming, diving, freediving, ice diving and floating, canyoning, cycling, mountain biking, hiking, horse riding, skiing and other mountain and water sports. You participate at your own risk. It is your responsibility to satisfy yourself as to your own fitness, health, competence, experience and insurance, and as to the suitability of any activity for every member of your party, including minors. You must comply with the operator's instructions and safety rules.
No endorsement or warranty
Listing an operator is not a recommendation, endorsement, certification or warranty by us as to that operator's quality, safety, legality, licensing, insurance, qualifications, punctuality or fitness for any purpose. To the fullest extent permitted by law, we accept no liability whatsoever arising out of or in connection with any third-party service, including any act, omission, negligence, delay, cancellation, non-performance, defect, injury, death, loss or damage of or caused by any operator or its personnel.
Enquiries you send us
When you send an enquiry through the Site you confirm that the information you give is accurate and that you are at least eighteen years old and legally able to enter into a booking.
Please do not send confidential, sensitive or special-category information, payment card details, bank details, identity documents or health information through the enquiry form. We do not ask for payment details through the Site and will never do so by email.
You must not use the enquiry form to send unlawful, defamatory, abusive, threatening, obscene, infringing or misleading material, or to send unsolicited commercial messages, bulk messages, malware or anything designed to interfere with the Site or any system.
Sending an enquiry places us under no obligation to respond, to hold any dates, or to arrange anything. How we handle the personal data in an enquiry is set out in the Privacy Statement.
Intellectual property
All content on the Site — including photographs, images, video, virtual tours, text, descriptions, copy, translations, layout, design, graphics, logos, icons, typography, arrangement, structure, source code and compilations — is owned by or licensed to Annecy74.com and is protected by French and international copyright, database, design and trade mark law. All rights are reserved.
The photographs of the property are original works commissioned by or licensed to us. They are not stock imagery and are not in the public domain.
What you may not do
Except as expressly permitted below, you may not copy, reproduce, download, scrape, harvest, republish, distribute, transmit, broadcast, display, sell, licence, rent, adapt, translate, modify, create derivative works from, frame, mirror or otherwise exploit any part of the Site, in any medium, without our prior written permission.
You may not use any content from the Site to advertise, list or market any property, including on any rental, listing, classified or social platform. You may not use our name, marks or images in a way that suggests association, endorsement or approval where none exists. You may not remove or obscure any copyright notice or watermark.
Text and data mining, scraping and automated extraction of content for the purpose of training or fine-tuning machine learning or generative artificial intelligence systems are expressly reserved and are not permitted without our prior written consent. This is an express reservation of rights for the purposes of Article 4(3) of Directive (EU) 2019/790 and Article L.122-5-3 of the French Intellectual Property Code.
What you may do
You may view the Site, and print or download extracts, for your own personal, non-commercial use in connection with considering or making a booking, provided you do not modify the content and you keep all copyright notices intact.
Acceptable use of the Site
You may not use the Site in any way that is unlawful or fraudulent, or that has any unlawful or fraudulent purpose or effect. In particular you must not:
- attempt to gain unauthorised access to the Site, its servers, or any system or network connected to it;
- introduce any virus, trojan, worm, logic bomb, keystroke logger or other malicious code;
- attack the Site by means of a denial-of-service attack or otherwise;
- use any robot, spider, scraper, crawler or other automated means to access, index, copy or monitor the Site or any part of it, other than a search engine operating in accordance with our robots.txt file;
- probe, scan or test the vulnerability of the Site, or breach or circumvent any security or authentication measure;
- reverse engineer, decompile or disassemble any part of the Site except to the extent that such a restriction is prohibited by law;
- impersonate any person, or misrepresent your affiliation with any person or entity;
- collect or harvest personal data from the Site.
We may suspend or withdraw access to the Site, in whole or in part, to any person, at any time, without notice and without liability. We may report any breach of this section to the competent authorities and will co-operate with them, including by disclosing your identity.
Links and third-party content
The Site links to third-party websites and services, including booking platforms, a scheduling tool, mapping services and a virtual tour. Those links are provided for convenience only.
We have no control over the content, availability, security, pricing or privacy practices of any third-party site or service, we do not endorse them, and we accept no responsibility or liability for them or for any loss or damage arising from your use of them. Your use of a third-party site or service is governed by that third party's own terms and privacy policy, which you should read.
You may link to the home page of the Site in a fair and legal way that does not damage our reputation or take advantage of it. You must not frame the Site, present it as your own, or suggest any association or endorsement where none exists. We may withdraw linking permission at any time without notice.
Availability of the Site
The Site is provided "as is" and "as available". We do not guarantee that the Site, or any content on it, will always be available, uninterrupted, timely, secure, error-free or free from viruses or other harmful components.
We may suspend, withdraw, discontinue or change all or any part of the Site without notice and without liability. We do not guarantee that the Site or its content is accurate, complete or up to date, and content may be out of date at any given moment.
You are responsible for configuring your own information technology and platform in order to access the Site, and for using your own virus protection software.
Limitation of liability
Nothing in these terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, and any liability that may not be excluded or limited under French law, including the non-waivable rights of consumers.
Subject to that paragraph, and to the fullest extent permitted by law:
- we exclude all conditions, warranties, representations and other terms which might otherwise be implied into these terms by statute, common law or otherwise;
- we will not be liable for any loss of profit, loss of revenue, loss of business, loss of anticipated savings, loss of opportunity, loss of goodwill, loss of data, loss of enjoyment of a holiday, wasted expenditure, or any indirect or consequential loss, however arising;
- we will not be liable for any loss or damage arising from your use of, or inability to use, the Site, or from reliance on any content on it;
- we will not be liable for any act, omission, default or insolvency of any third party, including any booking channel, property manager or service operator;
- we will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack or other technologically harmful material that may infect your equipment as a result of your use of the Site or of any site linked to it;
- our total aggregate liability arising out of or in connection with the Site and these terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to one hundred euro (EUR 100).
Different limitations and exclusions of liability apply to any stay, which is governed by the rental contract, and to any third-party service, which is governed by that operator's terms.
Indemnity
You agree to indemnify us and hold us harmless against all claims, demands, proceedings, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these terms, your misuse of the Site, or your infringement of the rights of any third party.
Events beyond our control
We are not liable for any failure or delay in performing any obligation arising out of the Site where that failure or delay results from an event beyond our reasonable control, including acts of God, fire, flood, storm, avalanche, drought, low or excessive snowfall, earthquake, epidemic or pandemic, war, terrorism, civil unrest, strike or industrial action, government action or restriction, border closure, failure of public or private telecommunications networks, failure of utilities, or failure of transport networks.

Our handling of personal data is described in the Privacy Statement, which forms part of these terms. Please read it.
Changes to these terms
We may revise these terms at any time by amending this page. The version in force is the one published here at the time you use the Site, and the date it was last updated is shown at the top of this page. Please check this page from time to time. Continued use of the Site after a change constitutes acceptance of the revised terms.
General
Severability
If any provision of these terms is held to be invalid, unlawful or unenforceable, that provision is to be severed and the remaining provisions continue in full force.
No waiver
A failure or delay by us in enforcing any provision of these terms is not a waiver of that provision or of any other, and does not prevent later enforcement.
Entire agreement
These terms, together with the Privacy Statement, constitute the entire agreement between you and us in relation to your use of the Site, and supersede any prior understanding in relation to it. Nothing in this paragraph limits liability for fraud.
Assignment
We may assign, transfer or subcontract our rights and obligations under these terms. You may not do so without our prior written consent.
Third parties
These terms are between you and us. No other person has any right to enforce them, save that our owners, managers, agents, affiliates and partners may rely on and enforce any provision of these terms that is expressed to be for their benefit.
Language
These terms are published in English. Where a translation is provided for convenience and there is any discrepancy, the English version prevails, save where French law requires otherwise for a consumer resident in France.
Governing law and disputes
These terms, their subject matter and their formation, and any non-contractual obligation arising out of or in connection with them, are governed by French law.
The courts of France have exclusive jurisdiction over any dispute arising out of or in connection with these terms or the Site. If you are a consumer resident in the European Union, you also retain the benefit of any mandatory protection and of any right to bring proceedings in the courts of your country of residence, which French law does not remove.
Mediation
A consumer has the right, under Articles L.611-1 and following of the French Consumer Code, to have recourse free of charge to a consumer mediator with a view to the amicable resolution of a dispute, after first making a written complaint to us. The European Commission also operates an online dispute resolution platform for consumers.
